LAWYERS FORM RIVAL BAR ASSOCIATION

History looks set to repeat itself as the country's lawyers have decided to their separate ways, in a move reminiscent of their past divisions.
About 5,000 lawyers gave up their membership to the Indonesian Advocates Association (Peradi) and established a new bar association called the Congress of Indonesian Advocates (KAI).
In their first congress here Friday, founders of the new association said it was a legitimate organization for representing their members and had the right to grant practicing certificates.
" Based on the 2003 advocate law, it's not true we can't practice without joining Peradi. In fact, we are insisting that all advocate organizations other than KAI are illegal, " KAI commitee member Luthfi Yazid told after the one day meeting.
He said at least 10,000 of the nation's 15,000 lawyers would return their membership cards to Peradi and sign up as KAI members by monday next week.
Among the noted lawyers that championed the establishment of the new bar association are presidential advisor Adnan Buyung Nasution, Teguh Samudera, Indra Sahnun Lubis, Ibrahim Hasibuan, Roberto Hutagalung, Jimmy Budiarjo and Suhardi Somomuljono.
President SUsilo Bambang Yudhoyono was initially slated to open the congress but canceled due to illness. Peradi executives had earlier written to the president, asking him to skip the KAI congress.
In a direct election, the lawyers voted Indra Sahnun Lubis the association's president and Roberto Hutagalung the secretary - general. They will form a complete organization structure within a month. Buyung was appointed honorary chairman.
Peradi amalgamated eight bar association in 2005, and since then has been recognized as the government - sanctioned group for advocates.
The Constiutional Court in 2006 rejected a judicial review of the law on advocates and unheld Peradi's status as an organization for Indonesian lawyers.
The court ruling did not say Peradi was the only sanctioned bar association, but court chief Jimly Asshidiqqie has interpreted it thus.
But some senior lawyers said Peradi was illegitimate because it was established without a congress and it's executives were not elected in accordance with international practice.
Peradi attracted criticism recently for dismissing noted lawyer Todung Mulya Lubis after finding him guilty of a conflict of interest.
Most recently a Peradi executive filed a defamation lawsuit against Buyung.
Buyung said in his opening speech President absence from the congress would not affect it's legitimacy.
" I hope this congress will create the only legitimate advocates organization in Indonesia, " he said.
In his statement, Buyung said KAI was the only legitimate organization for advocates in Indonesia and demanded Peradi and other advocate organizations be dissolved within one year.
Senior lawyer Frans Hendra Winarta expressed his concern over the division of the advocate organization, saying it would weaken the monitoring of Indonesian lawyers in implementing their code of ethics.
" It will confuse the public about which is the legitimate organization. I believe the split will adversely affect the protection of clients, " he said.
Frans called on Peradi and KAI to meet to discuss ways to consolidate.

Officials from the Corruption Eradication Commision (KPK) searched the excise and customs office in Tanjung Priok, north Jakarta, on Friday, in a surprise inspection.
Despite year - long efforts to suppress graft at the office, spearheaded by Finance Minister Sri Mulyani, they found bribes continued being delivered " through couriers , security personnel, cleaning service workers ", said M. Yasin, the KPK deputy, between news agency reported Friday.
Yasin said several envelopes containing hundreds of millions of rupiah were found in desks at the services section.
" Each bore the name of a company and the phrase ' meal money '," he said.
Yasin said the job of handling both excise and customs could be problematic for high - ranking officials.
As an example, he referred to one of the department's high ranking officials who was also a notary and a commissioner in a number of companies.
" This is despite the fact his salary has been raised. He has an allowance of Rp 46 million (US$4,900), " Yasin said.
Director general of excise and customs, Anwar Supriyadi, said surprise inspections could instill a culture of discipline in officers, the TEMPO INTERAKTIF online news agency reported. Inspections last year by the custom office showed there were more than 2,300 graft cases in the office, causing the state losses of up to Rp 97.84 billion, Anwar said.

In rememberance " KARTINI" To the champion of women's emancipation in Indonesia.....

Kartini was born Raden Ajeng Kartini on April 21, 1879. She was the third daughter of then Jepara regent K.R.M.A.A. Sasraningrat, through his union with his mistress M.A. Ngasirah.
According to the tale told by her young sister Kardinah, Kartini already showed signs when she was still small that she would grow to become an extraordinary woman.
This was indicated by her active character, inteligence, crotical nature and her constant desire to know about the issues she encountered, in addition to her abilities in caring for, guiding and instructing her younger sisters.
It is said that the young Kartini was a child who was passionate about studying. This caracteristic would eventually lead her to her fate as a thinking woman who would continuosly seek ways to free both society and her nation from the bonds of ignorance and oppression.
In fact, until her final days, Kartini continued to advocate for the development of the children of her nation.

She's reaching through barries, Kartini began her crusade when, in 1892, she entered seclusion. Seclucion was a conservative tradition practiced at the time by Javanese families of the noble class, where in all female children were kept at home once they reached adolescence, between 11-12 years old. It was not unusual that these young women, yearning for their freedom from this, were forced to accept a new " torture " upon their release from the trap of this tradition of seculsion ; that is, by being forced to enter into marriage with a man they did not know, often of an age very far from their own and who already possessed several wives and children. She's perhaps was still luckier than most. Her father was a man also of progressive thought and occasionally permitted her to accompany him on his official visits through the territories under Jepara regency. Kartini's physical body may have been imprisoned behind the walls of Jepara regency but her spirit and thoughts broke through the limits of space and time. Her intellect, social sensitivity and perceptions blossomed within her shackles and became ever more fertile with the new knowledge and experiences she gained through her correspondence with Dutch peers and close friends, the literature supplied by her father and dearest brother R.M.P. Sosrokartono as well as the long discussions she held with her sisters Rukmini and Kardinah.

Kartini is a pious woman.
At the end of 1903 she's received a proposal of marriage from K.R.M.A.A.Djojoadiningrat the regent of Rembang. Many to this day have questioned why Kartini in the end was willing to "trade" her idealism for a marriage to a polygamist when she knew very well that polygamy was just one of the causes of misery among women of her class. Whatever the case, she was a child who had a father and mother.

She's a heroine
On Sept 17, 1904 she's drew her last breath. Undoubtedly she left behind much to be done for the development of society and her nation.

ISLAND OF PALMAS CASE

Island of Palmas Case , (Scott, Hague Court Reports 2d 83(1932), (Perm. Ct. Arb. Awards 829), was a case involving a territorial dispute over the island of Palmas (or Miangas) between the Netherlands and the United States which was heard by the Permanent Court of Arbitration. Palmas, also referred to as Miangas, is an island of little economic value or strategic location. It is two miles in length, three quarters of a mile in width and has a population of about 750 when the decision of the arbitrator was handed down. The island is located between Mindanao, Philippines and the northern most island, known as Nanusa, of what was the former Netherlands East Indies. In 1898, Spain ceded the Philippines to the United States and Palmas sat within the boundaries of that cession on the U.S. In 1906, the United States discovered that the Netherlands also claimed sovereignty over the island and the two parties agreed to submit to binding arbitration to resolve the dispute on January 23, 1928. The arbitrator in the case was Max Huber, a Swiss national. The question the arbitrator was to resolve was whether the island of Palmas (Miangas), in its entirety was a part of the territory of the United States or the Netherlands.
